Dispute Settlement in the WTO
How Friendly is it for the LDC
The paper looks at the possibilities of LDC Members of the WTO to rely upon its dispute settlement provisions to gain the benefits they reasonably believe should accrue from their participation in the organisation. Part I of the paper reviews the evolution of the provisions in the GATT/WTO relating to dispute settlement, with special reference to the incorporation of special and differential treatment in their dispute settlement processes. Part II of the paper considers special challenges faced by the LDCs in dispute settlement, and what might be done about them.
